Following the Government's consultation in July 2024, the amendments to the Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) Regulations 2012 (as amended) will come into effect from 1st April 2025. The key changes are summarised below:

  • Householder applications (enlargement, improvement or other alteration to a dwellinghouse):
    • Fees for enlargement, improvement or other alteration to a single dwellinghouse will rise from £258 to £528;
    • Fees for enlargement, improvement or other alteration to two or more dwellinghouses will rise from £509 to £1,043;
    • The existing fee of £258 for householder developments related to small-scale operations within the curtilage of a dwellinghouse (excluding flats) e.g., construction of gates or fences, is not changing.

 

  • Prior Approvals (e.g., Class MA - commercial, business and service uses to dwellinghouses):
    • Flat fees for applications that don’t involve building operations will double from £120 to £240;
    • Flat fees for applications that involve building operations will rise from £258 to £516;
    • The fee for prior approvals relating to the change of use of Class E uses to residential (under Class MA of the GDPO) is increased from £125 per dwellinghouse to £250 per dwellinghouse.

 

  • Section 73 applications (amendments to existing permissions):

A new three-tier fee structure will be introduced (currently a flat rate of £292 regardless of development       type):

  • £86 for householder applications;
  • £586 for non-major development; and 
  • £2,000 for major development.

 

  • Discharge of Conditions:

The fee for an application for approval of details reserved by condition is increasing from:

  • £43 to £86 for householders; and
  • £145 to £298 for any other development.
  • Fee for submission of a Biodiversity (BNG) Gain Plan is increasing from £145 to £298.

 

  • Other fee ‘updates’:
    • Raising of base payment for applications over 50no. dwellings or for non-residential buildings more than 3,750sqm from £30,860 to £31,385 (plus £189 for each additional dwellinghouse or for each additional 75sqm of non-residential floorspace);
    • Raising of base payment for agricultural development over 1,000 sqm (but below 4,215sqm) from £624 to £5,077;
    • The Planning Portal service charge (flat rate) will also increase from £70 inc. VAT to £70.33 plus VAT;

 

The Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) (Amendment) Regulations 2023 introduced an automatic, annual increase. This will increase planning fees annually, on 1 April each year, starting on 1 April 2025. All planning fees will be increased by the rate of inflation, as measured by the Consumer Prices Index from the preceding September. The increase will be capped at 10%, even if the inflation rate is higher. The fees will not be changed if there is negative inflation (deflation).
